AFFILIATES TERMS AND CONDITIONS

 

1. INTRODUCTION

Welcome to The Soul Seeds PT Affiliate Program. This program is designed to collaborate with hotels, guest houses, travel agencies, and individuals who wish to promote our experiences in Bali in exchange for a pre-agreed commission.

These Terms and Conditions establish the rights and responsibilities of affiliates, as well as the rules and restrictions of the program. By registering as an affiliate, you agree to fully comply with these conditions.

2. DEFINITIONS

  • The Soul Seeds PT: A company registered in Indonesia, owner, and operator of tourism experiences in Bali.
  • Affiliate: An individual or legal entity that promotes The Soul Seeds PT experiences in exchange for a commission.
  • Customer: A person who books and pays for an experience through the affiliate.
  • Commission: Payment received by the affiliate for each confirmed booking made through their link or referral.
  • Affiliate Fraud: Any attempt to manipulate the affiliate system through unfair practices, such as self-purchases, fraudulent registrations, or misinformation.

3. PARTICIPATION REQUIREMENTS

To be part of the program, the affiliate must:

  • Be over 18 years old and have full legal capacity to contract.
  • Operate a registered business or act as an individual within the legal framework of Indonesia.
  • Not be involved in illegal, fraudulent activities or any actions that may damage the reputation of The Soul Seeds PT.
  • Sign an affiliate agreement outlining the specific terms of the collaboration.

4. REGISTRATION AND APPROVAL

  • To join the program, the affiliate must complete an application and provide the required information.
  • The Soul Seeds PT reserves the right to approve or reject any application without justification.
  • The affiliate must provide valid banking details or payment information to receive commissions.

5. COMMISSIONS AND PAYMENTS

  • The commission will be pre-agreed and outlined in the contract between The Soul Seeds PT and the affiliate.
  • Commission payments will be made on a monthly basis, within the first 10 business days of the following month after the customer’s experience has taken place.
  • To qualify for a commission, the customer must have fully paid and completed the experience.
  • No commission will be paid for canceled, fraudulent, or refunded bookings.
  • Commissions will be paid in the agreed currency and may be subject to taxes or withholdings as per Indonesian law.

6. AFFILIATE OBLIGATIONS

The affiliate must:

  • Promote The Soul Seeds PT experiences ethically and in alignment with the company’s image.
  • Use only promotional materials provided or approved by The Soul Seeds PT.
  • Not engage in deceptive practices or false advertising regarding the offered experiences.
  • Maintain the confidentiality of any commercial or strategic information provided by The Soul Seeds PT.

7. PROHIBITED ACTIVITIES AND UNFAIR PRACTICES

The affiliate may not:

  • Use spam practices to promote The Soul Seeds services.
  • Register domains, social media accounts, or online ads with names similar to The Soul Seeds without prior authorization.
  • Offer unauthorized discounts or promotions.
  • Mislead customers with false or distorted information about the services.

If any fraud or violation is detected, The Soul Seeds PT reserves the right to immediately cancel the affiliation and withhold any pending commissions.

8. CANCELLATION AND REFUND POLICY

  • If a customer cancels their booking, the affiliate’s commission will be voided.
  • If The Soul Seeds PT cancels an experience, the customer will receive a refund, and the affiliate will not receive a commission for that sale.
  • In case of a dispute regarding a booking, The Soul Seeds PT will make the final decision on the commission’s validity.

9. LIABILITY AND LIMITATIONS

  • The Soul Seeds PT does not guarantee a minimum sales volume or income for affiliates.
  • The company shall not be liable for economic losses, indirect damages, or claims arising from the affiliate’s activities.
  • In the event of changes in legislation, The Soul Seeds PT may modify the program’s terms without prior notice.

10. CONTRACT DURATION AND TERMINATION

  • The affiliation is valid for an indefinite period, unless either party decides to terminate the relationship.
  • The Soul Seeds PT may unilaterally terminate the affiliation in case of non-compliance with the terms.
  • The affiliate may cancel their participation at any time by notifying in writing at info@thesoulseeds.com.

11. MODIFICATIONS TO THE TERMS

The Soul Seeds PT reserves the right to modify these terms at any time. Affiliates will be notified of any changes at least 15 days in advance.

12. APPLICABLE LAW AND JURISDICTION

  • These terms and conditions are governed by Indonesian law.
  • Any disputes shall be resolved in the competent courts of Bali, Indonesia.
